Arash Beral Comments on DTSA Bill in Daily Journal

Freeman Freeman & Smiley, LLP Partner, Arash Beral, was quoted in today’s Daily Journal article, “House passes bill to allow federal lawsuits for trade secrets theft.”  The bill is the Defend Trade Secrets Act (DTSA), which would allow civil trade secrets lawsuits to be brought in federal court.  The bill passed by a vote of 410-2.

Mr. Beral stated, “There are many questions swirling around the DTSA, such as how courts will interpret and enforce several of its provisions, including its civil seizure provision.  For instance,” he continued, “the potential exposure to a trade secret plaintiff for a ‘wrongful or excessive’ seizure order may alone demand continued reliance on state law.”

“Whether California lawyers will embrace federal trade secret laws is far from certain,” Mr. Beral concluded.
