Daniel Jonathan is a senior counsel in our firm’s  Century City  office. A member of our Litigation Department, Mr. Jonathan counsels clients in highly sophisticated, complex legal matters and disputes.  With his background in accounting and finance, he is uniquely positioned to appreciate the financial nuances of his clients’ businesses, transactions, and disputes.

Accomplished trial attorney

Mr. Jonathan has significant experience taking disputes from inception through trial and appeal, including disputes regarding contracts, real estate, accounting, and intellectual property.  He has obtained favorable judgments in federal and state court trials, as well as in arbitration.  While a seasoned trial attorney, Mr. Jonathan has frequently resolved his clients’ disputes early in the dispute process, avoiding years of litigation.

In addition to representing clients in litigation matters, Mr. Jonathan has utilized his legal experience and business background to act as general counsel for businesses in a variety of fields, including real estate, technology, and manufacturing.  He has also assisted clients in a broad variety of transactions such as the purchase and sale of real property, commercial leases, financing, and joint ventures.

Prior to joining Freeman Freeman and Smiley, he was an accountant at a major national accounting firm and later an attorney at the top ranked firm in the AmLaw rankings, where he represented Fortune 500 companies.

Representative Clients and Matters

Represented the broker for the development of one of the largest residential towers in San Francisco in a $25 million dispute by a developer claiming to have been wrongly circumvented in the deal, and obtained a successful trial verdict fully exonerating Mr. Jonathan’s client.  The decision highlighted Mr. Jonathan’s cross-examination of the Plaintiff’s expert witness as having eviscerated Plaintiff’s case.

Obtained a $33 million judgment for a Fortune 50 client by successfully arguing that the revenues for the business acquired by the client had been fraudulently overstated.

In Cappucitti v. DirecTV, Inc., persuaded the 11th Circuit to overturn a finding that DirecTV’s arbitration agreement was unconscionable.

Successful on 48 of 50 line items in a working capital dispute to obtain an $11 million net benefit to a Fortune 50 client.

Successfully resolved profit participation disputes for clients in entertainment, professional services, and joint ventures.

Served as general counsel for several commercial real estate holding companies; in addition to counseling duties, he has led the acquisition, disposition, financing, and leasing of properties.
